Selling Hours

9:00 am - 4:00 pm


Seller Set-up and Move-out   
 
Move-in time for Reserved Sellers 7:00 am - 8:00 am.  No prepaid reservations will be held after 8:00 am.

Seller vehicles are not permitted to operate within the Flea Market from 9:00 am until after closing at 4:00 pm, unless approved by Site Managers.

Sellers may not move out before 3:00 pm.  Sellers must be off the site by 5:00 pm.

 
Canopies and Tents

All Sellers setting up a canopy or tent in a space must have it properly constructed and secured.  During unusually windy conditions Flea Market Management reserves the right to require Sellers to take down canopies and tents.

NOTE:  Seller accepts and agrees that Management shall not be responsible or liable for the Seller’s use of a canopy or its construction, and each Seller agrees to and shall hold Management harmless from, and indemnify Management against any injury or property damage that may occur due to the use of such equipment.


Weather and Refund Policy

While it is general policy that the market will operate rain or shine, Management has the discretion to cancel a market if it is raining heavily, or when the weather is intense or severely windy.  Reserve Sellers who show up on a day the market is cancelled will be issued a credit for a future market date.  There are no exchanges or refunds on spaces.


Vehicles & Pedestrians

Vehicles may remain in the selling space, or vehicles may be unloaded and moved prior to 9:00 am.  Parking in red or blue zones is prohibited.  The speed limit inside the market is 3 MPH. 
Pedestrians have the right of way at all times.


Smoking Policy

The Flea Market is a smoke-free event.  Alameda City ordinance prohibits smoking in outdoor public places.


Electricity
 
No electricity is available to selling spaces.  Generators are not allowed with the exception of use low noise generators by Food Vendors.

 
Display

Seller agrees to arrange merchandise items neatly.  No items shall be displayed directly on the asphalt.  Use of tarps, cloth, or mats is required for items displayed on the ground. Selling out of vehicles is prohibited.


Noise Level

Radios or music are to be kept at a low volume.

 
Merchandise prohibitions

Management does not allow for selling, display or giveaway: any type of drugs, drug paraphernalia, tobacco products of any kind; firearms, working or not, ammunition or explosives devices, weapons of any kind; stolen property/merchandise or video or cassettes which are pirated, dubbed, or in any violation of copyright law; pornographic graphic/printed materials; or items that by sale, possession, or use are in violation of College, City, County, State or Federal laws.


No Subletting Space

Subleasing of spaces is not allowed.  Sellers may not transfer or sell part of a booth, or turn a reservation over to another seller. All Sellers must reserve their own space.

 
Permits and Licenses

Sellers are responsible for obtaining a California State Seller’s Permit, if required, and for compliance with all applicable resale regulations.  Each Seller shall comply with all City, County, State and Federal laws pertaining to the selling of goods, and shall hold the Management harmless against any failure to do so.  Non-compliance will result in denial of opportunity to sell in the Market.


Cleanup

Sellers are required to keep and leave their rented spaces clean.  No waste/debris, cardboard, or unsold merchandise are permitted to be left on the College Campus.  At the end of the selling day, all trash and merchandise remnants must be removed from the premises.  There will be a $100.00 fee charged to those Sellers who are not in compliance. Sellers in violation of this policy may also have status as an approved Seller terminated. These terms will be strictly enforced.


Seller Code of Conduct


Communication and cooperation between Seller neighbors is expected.  Disruptive behavior, physical or verbal threats, or abusive behavior will not be tolerated and may result in immediate and permanent expulsion from the market.


Management Rights
 
       
All Rules, Regulations and Policies will be enforced.  Staff will be checking the event for compliance and Sellers who are in violation will be subject to not being allowed to participate in the current market and/or future events, temporarily or permanently.

Management reserves the sole and exclusive right to reasonably deny service and/or rent to anyone, or to require any Seller to leave for non-compliance of Rules, Regulations & Policies

 
Property

Sellers are advised that Management assumes no responsibility whatsoever to insure the safety or protect in any way, the property of the Seller from fire, theft, malicious mischief, accident, rain, wind, or other perils.  It is the Seller’s responsibility to protect their own property at all times during the market.


Liability


In consideration of Management accepting the Seller’s space fee, the Seller and any companions, helpers, family members, or others occupying the space, including but not limited to, Seller’s successors, assigns, heirs, executors and administrators, hereby waive and release any and all rights and claims against the following persons and organizations affiliated with this event: the Management, the College of  Alameda, the Peralta Community College District, the City of Alameda, the County of Alameda and the State of California, while participating at this event or at any future time.
